Executive Order 14248: a unilateral attempt to rewrite federal election procedure

Scores: V 87, C 82, scored on September 27, 2026
Institutional outcome
Federal courts blocked significant portions; the citizenship-documentation requirement was permanently blocked via summary judgment; in a later ruling the same judge wrote that 'our Constitution does not allow the President to impose unilateral changes to federal election procedures'
What happened

Trump signed EO 14248, 'Preserving and Protecting the Integrity of American Elections,' unilaterally attempting to require documentary proof of citizenship on the federal voter-registration form, mandate DOJ prosecution of states that count mail ballots received after Election Day (even if postmarked on time), condition federal election funding on state compliance, and direct new DOJ/state data-sharing on voter rolls.

The Constitution assigns authority over federal election administration to Congress and the states, not the president; multiple federal courts, in LULAC v. EOP (D.D.C.) and California v. Trump (D. Mass.), blocked significant portions of the order through 2025.

A federal court permanently blocked the citizenship-documentation provision via summary judgment on October 31, 2025; in a later ruling blocking two more citizenship provisions, the same judge wrote: 'Put simply, our Constitution does not allow the President to impose unilateral changes to federal election procedures,' one of the clearest judicial findings in this entire index that a specific presidential action exceeded constitutional authority.
