Jenner & Block: struck down, and DOJ's reversal on appeal
Editor's note: a federal court held the order an unconstitutional act of retaliation and enjoined it in full.
Trump issued an executive order against Jenner & Block on March 25, 2025, using the same template as Perkins Coie's order, specifically citing the firm's past employment of Andrew Weissmann, a prosecutor on Robert Mueller's Russia-investigation team, and describing the firm's work as 'obvious partisan representations to achieve political ends.'
Jenner & Block sued rather than settle. A federal court granted summary judgment in the firm's favor, finding the order unconstitutional on the same First Amendment and separation-of-powers grounds as the Perkins Coie ruling.
DOJ moved on March 2, 2026 to drop its appeals in the law-firm cases, then withdrew that motion the next day and asked the D.C. Circuit to overturn the rulings. The consolidated appeal was argued on May 14, 2026.
