Penn: no payment, but a rewritten athletics policy, reversed records, and written apologies
Days after Trump's February 5, 2025 executive order 'Keeping Men Out of Women's Sports,' the Department of Education's Office of Civil Rights opened a Title IX investigation into Penn over transgender swimmer Lia Thomas's participation in a 2022 women's championship. On March 19, 2025, the administration suspended $175 million in discretionary Defense and HHS funding tied to research across seven Penn schools, including hospital-infection prevention, drug screening against deadly viruses, and chemical-warfare protections, citing the athletics policy dispute.
Penn came to the negotiating table in the following months; the deal, announced July 1, 2025, required the university to issue a statement affirming Title IX compliance, formally reverse and restore the swimming records and titles of the women who competed against Thomas, and write individual apology letters to those athletes. Education Secretary Linda McMahon said publicly: 'We told them that institutions that violate federal civil rights law could lose their federal funding... So UPenn came back to the table.' Funding was restored the next day.
Unlike every other university documented in this bucket, Penn's settlement required no monetary payment. It was resolved entirely through policy compliance and symbolic reversal (records, titles, apologies), making it the clearest example of the funding-freeze tool being used to extract a specific substantive policy outcome rather than a payment.
